Agreement to These Terms

These Terms of Service (“Terms”) are a legal agreement between you and Love Peapie LLC (“Love Peapie,” “we,” “us,” or “our”) governing your access to and use of Love, Peapie™, including the Love, Peapie™ mobile application, lovepeapie.com, and related services, features, content, and functionality (collectively, the “Services”).

By creating an account, accepting an invitation as a Guest, purchasing or using a paid feature, or otherwise accessing or using the Services, you agree to these Terms and the policies and additional terms incorporated by reference. If you do not agree, do not use the Services.

About Love, Peapie™

Love, Peapie™ is a private memory-preservation service designed to help Owners preserve photos, videos, letters, voice notes, comments, and related memories within their Collections over time and, where available, create Keepsake Books or PDFs from eligible content.

Love, Peapie™ is not intended to be a public social network. User Collections and User Content are not made public merely because they are stored through the Services.

Eligibility and Age Requirements

You must be at least 16 years old and legally capable of agreeing to these Terms, including any legally required parental or guardian consent, to create an account or access the Services as an Owner or Guest. Additional age restrictions may apply under law or platform rules.
The minimum age to create an account, participate as a Guest, or purchase a subscription is 16, subject to applicable law and platform requirements.
You may not use the Services if your access has been permanently terminated by Love Peapie for serious violations, or if use would violate applicable law or applicable platform restrictions.

Subscriber Accounts and Collection Roles

Love, Peapie™ uses one Subscriber account structure. A Subscriber may have different roles in different Collections and may access multiple Collections through the same login.
Owner: A Subscriber who creates and controls an Owner Collection. An Owner may create or upload eligible Owner Content, invite or remove Guests, and exercise the Owner permissions available for that Collection.
Guest: A Subscriber who participates in an Owner’s Collection after invitation by the Owner. Guests may view authorized content and participate in comments and reactions where permitted but do not control the Owner’s Collection or create or upload Owner Content into that Collection.
A Subscriber may be an Owner in one Collection and a Guest in another. The same login may be used for multiple Owner Collections, subject to available account functionality. Each Owner Collection requires its own separate paid subscription. A subscription applies only to the Owner Collection for which it was purchased, and separate Collections cannot be merged or consolidated.
A Subscriber participating solely as a Guest in another Owner's Collection is not required to purchase a separate subscription to access the features and content made available to Guests.
Guest permissions are further described in the Consent & Guest Terms. A Subscriber participating only as a Guest who wishes to create and store their own Owner Content may create an Owner Collection and purchase a separate subscription using the same Subscriber account and login.

Account Registration and Security

You agree to provide information reasonably required to create and maintain your account and to keep applicable account information current. You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account or authorized device, except to the extent otherwise required by law.
You may not share credentials in a manner that defeats account permissions or security controls, impersonate another person, or attempt to access another user’s account or private content without authorization.
Love Peapie may use authentication, age-verification, multifactor-authentication, or other security measures as available and appropriate.

Collections, Invitations, and Guest Access

Only the Owner may invite Guests to the Owner’s Collection. Invitations are email-based. Guests must download the app, create or sign in to a Subscriber account, accept the invitation and applicable terms, and obtain Guest access to the applicable Collection before participating.
The Owner may remove a Guest at any time. Removal immediately revokes the Guest’s access. If access is later desired, the Owner must send a new invitation.
Guests do not have access to the Owner’s personal account information. The Owner may view limited Guest information, such as screen names and email addresses, as reasonably necessary to send invitations, manage Guest access, and administer the Owner’s Collections.

Content Visibility

Content visibility depends on the content type and user role. Under the current service model:

Photos and videos shall be visible to the Owner and authorized Guests.
Letters are private to the Owner.
Voice notes are private to the Owner.
Chat comments shall be visible to the Owner and invited Guests with access to the related content.
Love Peapie may update technical implementation as the Services evolve. Material changes to privacy or participation rules will be addressed through applicable policies and notices.

User Content

Users retain ownership of their User Content. By providing User Content through the Services, users grant Love Peapie only the limited permissions reasonably necessary to host, store, process, secure, display to authorized users, back up, transmit, and use the content to provide requested Services.

The detailed rules governing User Content, intellectual-property ownership, Keepsake Book processing, QR-linked media, and Love Peapie-owned materials are contained in the User Content & Intellectual Property Terms, which are incorporated into these Terms.

Owner Responsibilities for Content

An Owner is responsible for content the Owner creates or uploads and represents that the Owner has the rights, permissions, or lawful authority reasonably necessary to provide and use that content through the Services.

User Content may depict or concern other people, including children. Owners are responsible for considering and obtaining any permissions or consents required by applicable law or their relationship with those individuals.

Love Peapie does not acquire ownership of a person’s image, likeness, voice, writings, or other rights merely because the person appears in User Content.

Guest Activity

Guests may add chat comments and reactions. Guests may not upload photos, videos, letters, voice notes, or similar Owner Content into another Owner’s Collection.

Comments are visible as described in the applicable Collection permissions. Deleted comments are permanently removed through the applicable functionality and are not included in future Keepsake Books.

Historical Guest comments and their displayed-name attribution may remain in the Owner Collection after the Guest deletes their account, where technically supported and legally permitted. The handling of this information remains subject to confirmation and the Privacy Policy; deletion of the Owner Collection removes its stored comments.

Acceptable Use

You must use the Services lawfully and in accordance with the Acceptable Use / Community Guidelines. Prohibited conduct includes misuse of private content, infringement of intellectual-property or privacy rights, unauthorized access, abusive or unlawful activity, attempts to defeat security controls, and other conduct prohibited by applicable policies or law.

Love Peapie may investigate, restrict, remove, suspend, preserve, or report content or accounts when reasonably necessary to enforce these Terms, protect users or the Services, comply with law, or address serious safety concerns.

Child Safety and Serious Prohibited Content

Love Peapie prohibits child sexual exploitation and other unlawful exploitative content. When content is reasonably suspected to involve child sexual exploitation, Love Peapie may immediately suspend the relevant account and Collection while the matter is reviewed.

If exploitation is confirmed or reporting is legally required, Love Peapie may permanently terminate access, preserve relevant data as required, make legally required reports to appropriate authorities or organizations, and retain data until legally permitted to delete it.

A false positive may be restored after appropriate review. Additional procedures may be maintained in internal safety and incident-response documentation.

Subscriptions

Each Owner Collection requires its own paid subscription purchased through the Apple App Store or Google Play. A Subscriber may own multiple Owner Collections under the same Subscriber account and login, but each Owner Collection requires a separate paid subscription.

Subscription pricing, billing frequency, renewal, cancellation, refunds, and related terms are governed by the Subscription, Billing, Cancellation & Refund Policy, applicable app-store terms, and the purchase information presented at the time of transaction.

Love Peapie does not guarantee that pricing, plan names, storage allowances, or feature packages will remain unchanged. Material changes will be communicated as required by applicable law and platform rules.

Cancellation and Read-Only Status

Canceling renewal does not delete an account or Collection. A Collection remains active until the paid entitlement actually ends, taking applicable Apple or Google grace, billing-retry, or recovery periods into account. Once entitlement ends, the Collection becomes inactive and read-only under the applicable lifecycle rules.

During inactive read-only status, the Owner and authorized Guests may view previously accessible content under existing permissions, and Guests may save previously authorized photos and videos where that functionality is available. No new Owner memories, comments, reactions, or other new Collection activity may be added.

Resubscribing before permanent deletion reactivates that Collection; removed Guests are not automatically reinstated.

Keepsake Books and PDFs

Owners may create and purchase Keepsake Books from their Owner Collections. Guests may create and purchase their own Keepsake Book PDF using only content they are authorized to access within the applicable Owner Collection. Creating a Keepsake Book PDF does not expand a Guest’s access or permissions within the Owner Collection.

The Subscriber creating the Keepsake Book chooses a beginning and ending date. Love, Peapie™ automatically includes the eligible Collection content within that date range. Content is included and ordered according to its assigned memory date, not its upload date. The Subscriber does not manually select individual memories.

Specific Keepsake Book functionality, layout, pricing, fulfillment, printing, and QR features may be described in separate Keepsake terms, product disclosures, or purchase screens.

Third-Party Printing and Fulfillment

Love Peapie may make optional physical printing available through an approved third-party printing or fulfillment provider. When a Subscriber chooses physical printing, the completed Keepsake Book PDF and only the additional information reasonably necessary to fulfill the order may be provided to the approved third-party provider, subject to applicable technical design, contractual safeguards, and privacy practices. The third-party provider, rather than Love Peapie, handles the applicable physical printing and fulfillment services.

Third-party providers may have their own terms governing their services. Love Peapie is not responsible for a third party’s independent services except to the extent required by applicable law or expressly stated in Love Peapie’s own terms.

QR-Linked Media

Love, Peapie™ may generate QR codes for eligible videos and voice media associated with completed Keepsake Books. QR codes are intended to use stable links and a secure playback experience, but app-free or login-free playback and long-term independent archival remain subject to technical confirmation.

QR-linked memories in completed Keepsake Books are intended to remain accessible independently of an active subscription or the original Collection through a separate secure archival system. However, long-term hosting, stable playback, and survival of Owner account deletion remain subject to technical implementation and applicable privacy, safety, retention, and legal requirements. No specific hosting duration or uninterrupted-access guarantee is made.

Deletion of individual media or an Owner account may cause previously printed QR codes to stop working. Preservation of separately archived QR-linked media following deletion is a business objective, not a confirmed feature. The Services will describe available QR controls and deletion consequences before users rely on them.

Account Deletion

Love, Peapie™ provides self-service account deletion through Settings > Privacy & Security > Delete Account. No optional 60-day recovery period is offered. Deletion of an Owner account permanently removes the associated Collection, its stored memories and comments, and Guest access, subject to legally required preservation and technical processing limitations. Previously printed physical Keepsake Books remain unchanged; QR-linked media may become unavailable. Deleting an account does not necessarily cancel an Apple or Google subscription, which may require separate cancellation.

Deletion of an Owner account ends Guest access to the associated Collection. Deleted Collections cannot be restored through resubscription. Any technical timing, verification, backup or legally required retention exceptions will be explained in applicable deletion disclosures.

Deletion, recovery, retention, QR-linked media, legal holds, backups, and other lifecycle effects are governed by the applicable deletion and retention policies.

Inactive Accounts and Retention

When a paid Owner Collection subscription ends, the Collection becomes inactive and read-only. Love Peapie’s business retention rule is to retain the inactive Collection and necessary associated account data for two years from the end of paid entitlement. Login alone does not reset this period; resubscription before deletion reactivates the existing Collection and ends the inactive-retention countdown. After the period expires, the Collection is scheduled for permanent deletion, subject to legally required exceptions and any separately archived Keepsake QR media. Technical implementation and notice delivery remain under review.

Subscription inactivity, account deletion, suspension, and legal or safety holds are different account states and may have different consequences. The applicable retention and lifecycle policies control those distinctions.

Ownership Transfer, Incapacity, and Deceased Owners

Owner Collections cannot be transferred, reassigned, or consolidated with other Owner Collections through the Services. If an Owner dies or becomes incapacitated, Love Peapie may consider a verified legal representative’s request through a controlled administrative process, including a temporary pause of scheduled deletion where appropriate. This does not transfer ownership or automatically extend retention.

Love Peapie does not have, and will not disclose or transfer, an Owner’s password. A Guest is not automatically a legal representative, and Love Peapie has no duty to discover an Owner’s death or incapacity. Any representative request is subject to identity and authority verification, applicable law, and available administrative procedures.

Intellectual Property of Love Peapie

Love Peapie LLC and its licensors retain all rights in the Services and Love Peapie-owned materials, including software, branding, trademarks, interface designs, documentation, layouts, graphics, and other intellectual property owned by or licensed to Love Peapie.

Subject to these Terms, Love Peapie grants users a limited, revocable, non-exclusive, non-transferable right to access and use the Services and Love Peapie-owned materials for their intended personal use.

Copyright Complaints and DMCA

Love Peapie respects intellectual-property rights. Copyright complaints and notices should be submitted and handled according to the Love, Peapie™ Copyright & Intellectual Property Policy and Copyright/DMCA Policy.

Love Peapie may remove or restrict allegedly infringing content and take other action consistent with applicable law and its policies.

Privacy

Love Peapie’s collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy and related privacy and data-retention materials.

The website Cookie Notice separately describes cookies and similar technologies used on lovepeapie.com. Website cookie practices may differ from technologies used by the mobile application.

Notifications and Communications

Love, Peapie™ may provide service-related notices through the app, email, website, app-store mechanisms, or other reasonable channels. Subscribers may control optional push notifications through their account-wide notification settings. Activity notifications are intended to be generic and not display private content previews.

Users are responsible for maintaining an email address or other contact information sufficient to receive important account, legal, billing, deletion, inactivity, or policy notices where applicable.

Third-Party Platforms and Services

The Services may depend on or link to third-party platforms and services, including Apple, Google, Wix, hosting, security, payment, printing, fulfillment, or other providers. Third-party services may be governed by their own terms and privacy practices.

Love Peapie does not control the availability, accessibility, security, or operation of independent third-party services, although Love Peapie may establish contractual requirements for providers processing Love Peapie data on its behalf.

Advertising

Love, Peapie™ will display advertising within the mobile application. Advertising is intended to be presented in a manner that does not unreasonably interfere with the primary memory-preservation functions of the Services.

Advertisements may be provided by Love Peapie or by third-party advertising providers. Third-party advertisements may link to products, services, websites, or applications operated independently of Love Peapie. Love Peapie does not endorse or guarantee third-party products or services merely because an advertisement appears through the Services.

The technologies used to provide, measure, or manage advertising, and any information collected, used, or disclosed in connection with advertising, will be described in the applicable Privacy Policy, consent disclosures, or other privacy notices as required.

Love Peapie may modify advertising placement, format, frequency, providers, or availability as the Services evolve, subject to applicable law and platform requirements.

Availability and Changes to the Services

Love Peapie may add, modify, improve, discontinue, or replace features as the Services evolve. We do not guarantee uninterrupted or error-free operation or that every feature will remain available indefinitely.

Where a change materially affects user rights, paid services, privacy, retention, or other legally significant matters, Love Peapie will provide notice when required or appropriate.

Suspension and Termination

Love Peapie may restrict, suspend, or terminate access when reasonably necessary for security, safety, legal compliance, nonpayment, platform restrictions, serious policy violations, prohibited content, misuse of the Services, or other grounds permitted by these Terms or applicable law.

Suspension or termination may affect Owners and Guests differently depending on the account state and reason. Serious child-safety matters may result in immediate suspension of the entire Collection and loss of access for both Owner and Guests.

Termination does not eliminate obligations or rights that by their nature should survive, including intellectual-property rights, lawful retention obligations, payment obligations already incurred, and provisions concerning disputes or liability.

Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. Love Peapie does not warrant that the Services will be uninterrupted, error-free, completely secure, compatible with every device or assistive technology, or free from all data-loss risks.

Love Peapie is a memory-preservation service, not an archival guarantee. Users should consider maintaining appropriate independent copies of irreplaceable content where feasible.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, Love Peapie LLC and its officers, managers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, opportunities, or data, arising from or related to the Services.

Any limitation of liability will apply only to the extent permitted by applicable law. Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

If Love Peapie later adopts a specific aggregate monetary liability cap, that cap will be stated in an updated version of these Terms before being relied upon.

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your infringement or misappropriation of another person’s rights.

This provision does not require a user to indemnify Love Peapie for Love Peapie’s own unlawful conduct or for obligations that cannot lawfully be shifted to the user.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles, except to the extent applicable law requires otherwise.

The specific venue, dispute-resolution process, and any arbitration or class-action provisions, if adopted, will be stated in these Terms before they are enforced against users. Love Peapie does not rely on an unstated arbitration requirement.

Nothing in these Terms prevents either party from exercising rights that applicable law does not permit the parties to waive.

Love Peapie may update these Terms as the Services, legal requirements, business practices, or features change. Ordinarily, Love Peapie will notify users by email with a link to the updated policy, unless applicable law requires another notice or affirmative consent. The revised Terms will identify a new Effective Date.

The current version will identify its effective date and last-updated date. Love Peapie LLC will retain prior versions internally in accordance with its document-control and retention practices.

Accessibility Statement
Keepsake Book, QR, or other feature-specific terms and disclosures when applicable

If feature-specific terms conflict with these Terms regarding that feature, the more specific terms control for that subject unless they state otherwise.

If a provision of these Terms is found unenforceable, the remaining provisions will continue to the extent permitted by law, and the affected provision will be interpreted or limited as necessary to make it enforceable where possible.

A failure by Love Peapie to enforce a provision on one occasion does not waive the right to enforce it later.

Users may not transfer their account or these Terms to another person except through an ownership-transfer process expressly provided by Love Peapie. Love Peapie may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or other lawful business transaction, subject to applicable law and privacy obligations.

These Terms, together with the incorporated policies and applicable feature-specific terms, constitute the agreement between the user and Love Peapie LLC concerning the Services and supersede prior agreements concerning the same subject to the extent stated by law.

Internal working documents, drafts, FAQs, marketing statements, or informal communications do not modify these Terms unless Love Peapie expressly adopts the change as part of the applicable agreement.
